You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials, for all activities under your Account, and for notifying us immediately of any unauthorised access. You must be at least 18 years old or meet the legal age requirement in your jurisdiction.

4. Service Description and Availability

SkyPhage is a distributed compute platform that enables users to deploy WebAssembly workloads across a global network of reliability-scored hosts. The platform provides geo-aware orchestration, real-time monitoring, public HTTP gateway routing with automatic TLS, and resource-based workload matching.

We aim to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify or discontinue any part of the Service with reasonable notice.

5. Subscriptions and Payment

The Service operates under tiered subscription plans, billed monthly or annually in GBP excluding VAT. Payments are processed by Stripe. Refunds are available within 14 days of your initial subscription if you are unsatisfied with the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorised access to the Service or its infrastructure.
  • Disrupt, interfere with, or degrade the Service for other users.
  • Transmit malicious code, viruses, or harmful data through the platform.
  • Infringe on any third-party intellectual property or other rights.
  • Resell or redistribute access to the Service without authorisation.
  • Exceed usage limits associated with your subscription plan.
  • Use automated means to access the Service beyond provided APIs and SDKs.

7. Intellectual Property

skyphage.com owns all rights in the Service. You retain ownership of your Content and grant us a limited licence to store, process, and transmit your Content solely for the purpose of providing the Service. Feedback you provide may be used without compensation.

8. Data Protection

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 as described in our Privacy Policy. Where you upload personal data as part of a Workload, you act as data controller; we act as data processor.

9. Confidentiality

We will maintain the confidentiality of your Content except as required for service provision, legal compliance, or with your consent. You must protect API credentials and report any compromise immediately.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind. Our total liability is limited to amounts paid by you in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages, except where liability cannot be excluded by law (including negligence causing death or personal injury, and fraud).

11. Indemnification

12. Termination

You may terminate your Account at any time. We may terminate or suspend your access immediately for material breach of these Terms. Upon termination, your right to use the Service ceases and your Content may be deleted after a reasonable retention period.

13. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated with at least 30 days’ notice by email. Continued use of the Service after the notice period constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of the courts of England and Wales. We encourage informal resolution before legal action.

15. General Provisions

These Terms constitute the entire agreement between you and skyphage.com regarding the Service. If any provision is found to be unenforceable, the remaining provisions continue in full force. You may not assign your rights under these Terms without our consent; we may assign ours without restriction.
